  • Refuse service to any person at our sole discretion, subject to applicable law including the CPA.

6. Orders and Quotations

Quotations

Any quotation provided by us is valid for the period stated on the quotation document. If no validity period is stated, the quotation is valid for 30 days from the date of issue, unless withdrawn or amended by us before acceptance. A quotation does not constitute an offer or binding agreement.

Placing an Order

An Order submitted by you constitutes an offer to purchase. No Order is binding on us until we issue a written order confirmation or tax invoice. We reserve the right to accept or decline any Order at our discretion. In the event of a pricing error or system malfunction, we reserve the right to cancel a confirmed Order and issue a full refund.

Order Confirmation

On acceptance of your Order, we will send an order confirmation to the email address provided by you. It is your responsibility to ensure your contact details are accurate. We are not liable for non-delivery of confirmations due to incorrect contact details.

7. Pricing and Payment

Pricing

All prices are quoted in South African Rand (ZAR) and are exclusive of Value Added Tax (VAT) unless expressly stated otherwise. VAT will be added at the applicable rate and reflected on your tax invoice. Prices are subject to change without notice prior to Order confirmation.

Payment Terms

Payment is due in accordance with the terms set out on your quotation or tax invoice. Unless otherwise agreed in writing, payment must be received in full before goods are dispatched or services are rendered. We accept the following payment methods:

  • Electronic Funds Transfer (EFT)

  • Credit or debit card (where available via our payment gateway)

  • Such other methods as we may advise from time to time

Late Payment

Overdue amounts will attract interest at the maximum rate permitted under the Prescribed Rate of Interest Act 55 of 1975 (as amended), calculated from the due date until the date of payment in full. We reserve the right to suspend or cancel Services where payment is overdue.

Disputed Invoices

If you dispute any invoice, you must notify us in writing within 7 Business Days of the invoice date. Undisputed portions of an invoice remain payable by the original due date.

8. Delivery and Risk

Delivery

Delivery timelines provided by us are estimates only and are not guaranteed. We will make reasonable efforts to deliver by the estimated date, but we are not liable for delays caused by circumstances beyond our reasonable control, including supplier delays, logistics disruptions, acts of God, or customs clearance.

Delivery Charges

Delivery charges, where applicable, will be set out in your quotation or at the time of ordering. Delivery charges are payable in addition to the product price unless expressly stated to be included.

Risk and Ownership

Risk in goods passes to you upon delivery. Ownership (title) in goods remains with us until payment in full has been received for those goods (retention of title). Until ownership passes, you must keep the goods identifiable as our property and store them separately from other goods.

Inspection on Delivery

You must inspect all goods upon delivery and notify us in writing of any damage, shortage, or discrepancy within 48 hours of receipt. Failure to do so will be deemed acceptance of the goods in good order, subject to your rights under the CPA.

9. Returns, Cancellations, and Refunds

Returns

Returns are accepted subject to the following conditions:

  • The goods must be returned within 7 Business Days of delivery;

  • Goods must be unused, undamaged, and returned in their original packaging;

  • A valid proof of purchase must accompany all returns; and

  • Certain items (including special-order or custom parts) may not be eligible for return — this will be confirmed at the time of purchase.

Cancellations

Orders may only be cancelled prior to dispatch. To cancel an Order, please contact us immediately at legal@sidehustle.co.za or +27 (0)63 120 4489. Cancellations of special-order items may be subject to a cancellation fee reflecting costs already incurred.

Refunds

Approved refunds will be processed within 14 Business Days of our confirmation of the refund. Refunds will be made using the same payment method as the original transaction unless otherwise agreed.

Consumer Protection Act

Where you are a Consumer under the CPA, your rights under sections 56 (implied warranty of quality), 20 (right to cancel certain transactions), and other applicable provisions of the CPA are not limited or excluded by these Terms.

10. Warranties and Guarantees

Manufacturer Warranty

Products are sold subject to the warranty terms provided by the relevant manufacturer or supplier. The specific terms, duration, and scope of any manufacturer warranty will be communicated to you at the time of purchase. We will facilitate warranty claims on your behalf where applicable.

CPA Implied Warranty

In accordance with section 56 of the CPA, goods sold to Consumers carry an implied warranty of quality for a period of 6 months from the date of delivery, unless a longer warranty period applies. This implied warranty is in addition to any manufacturer warranty.

Warranty Exclusions

Warranties do not cover damage resulting from:

  • Misuse, abuse, or neglect;

  • Unauthorised modifications or repairs;

  • Use contrary to the manufacturer's specifications or our instructions;

  • Normal wear and tear; or

  • Damage caused by third parties or force majeure events.

11. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, images, icons, audio clips, software, and the compilation thereof, is the property of Side Hustle Industries (Pty) Ltd or its content suppliers and is protected by South African and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Website for its intended purpose only. You may not:

  • Copy, reproduce, distribute, or republish any content from the Website without our prior written consent;

  • Modify, adapt, translate, or create derivative works from any content;

  • Use any content for commercial purposes without our express permission; or

In terms of ECTA section 42, you have the right to cancel any electronic transaction within 7 days of receipt of goods or services, subject to the exceptions set out in that section.

20. Consumer Protection Act Rights

Where you qualify as a Consumer under the Consumer Protection Act 68 of 2008 (CPA), the following rights apply and are not limited or excluded by these Terms:

  • Right to equality in the consumer market (s.8–9): You have the right to fair and equal treatment.

  • Right to privacy (s.11): You have the right to restrict unwanted direct marketing communications.

  • Right to choose (s.13–21): Including the right to cancel certain advance bookings and agreements within the prescribed cooling-off period.

If you have a complaint under the CPA, you may contact the National Consumer Commission at www.thencc.org.za or the relevant consumer court in your province.

21. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.

Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, the parties agree to first attempt to resolve the matter informally by contacting us at legal@sidehustle.co.za. We will endeavour to respond and seek resolution within 14 Business Days.

Jurisdiction

If informal resolution is unsuccessful, both parties consent to the non-exclusive jurisdiction of the Magistrates' Court or High Court of South Africa (Gauteng Division, Pretoria) having jurisdiction over the matter, depending on the quantum of the claim. This does not limit your right to approach any other court of competent jurisdiction.

22. Amendments to These Terms

We reserve the right to amend these Terms at any time. Where changes are material, we will take reasonable steps to notify you by posting a notice on the Website or sending an email to registered users. We will revise the effective date at the top of these Terms.

Your continued use of the Website or Services after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must cease using the Website and Services.

Entire Agreement

Assignment

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, labour disputes, war, government action, pandemics, or failure of third-party service providers.

Language

These Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
